The Supreme Court has upheld the judgment of a Federal High Court barring the Central Bank of Nigeria (CBN) and the Accountant-General of the Federation from releasing statutory monthly allocations to Rivers State.
In a ruling delivered on Friday, a five-member panel of the apex court also ordered the Martins Amaewhule-led faction of the Rivers State House of Assembly—loyal to Nyesom Wike, Minister of the Federal Capital Territory (FCT)—to resume sitting.
The decision reverses an earlier ruling by the Abuja Court of Appeal, which had set aside the Federal High Court’s judgment. The lower court had halted the release of funds to Rivers State after Governor Siminalayi Fubara failed to re-present the 2024 Appropriation Bill before the Amaewhule-led assembly.
Justice Emmanuel Agim, who delivered the lead judgment, ruled that the 27 lawmakers alleged to have defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) remain valid members of the Rivers Assembly until the suit challenging their status is fully determined.
“The members of the Rivers State House of Assembly who allegedly defected are still legitimate members and have the power to conduct the business of the assembly,” Agim stated.
He further declared that any group claiming to be the Rivers Assembly outside of the Amaewhule-led faction is acting illegally. The judge criticized Governor Fubara for attempting to govern with only four out of 32 assembly members, calling it “an act of indiscipline bordering on excessive use of power, and a joke taken too far.”
The Supreme Court ordered that all allocations to Rivers State remain suspended until the presentation and approval of a legitimate budget by the Amaewhule-led assembly. It also imposed a N5 million cost against Fubara.
As news of the judgment broke, Wike and his allies were seen singing in celebration; a moment he proudly shared on his X account.
